Two Separate Proceedings Start the Day You’re Arrested
A DUI arrest in California triggers two independent cases at once. The criminal court handles the charge itself. The DMV simultaneously moves to suspend your license through what’s called an Administrative Per Se (APS) hearing, an administrative proceeding entirely separate from your criminal case. You have only 10 days from the date of arrest to request that DMV hearing. Miss that deadline and the suspension takes effect automatically, typically four months for a first offense with a blood alcohol concentration of 0.08% or higher.
On the criminal side, first offense DUI cases arising in Van Nuys are arraigned at Van Nuys Courthouse West, with misdemeanor arraignments held in Department 103. Acting quickly after arrest matters on both fronts.

A first DUI in California is typically charged as a misdemeanor. Aggravating factors, including a prior felony DUI, serious injury to another person, or three or more prior DUI convictions within 10 years, can elevate the charge. For a standard first offense, here’s what the law authorizes:
With Informal Probation
Informal (unsupervised) probation is the more common outcome for straightforward first offenses and does not require mandatory jail time in Los Angeles County.
- Base fine of $390 to $1,000 (assessments raise the total substantially)
- A 3-month DUI education program, extended to 6 months if your BAC was 0.20% or higher or if you refused testing
- No mandatory jail time in Los Angeles County
Without Probation
A first DUI conviction without probation carries a heavier set of consequences.
- 96 hours to 6 months in county jail
- Base fine of $390 to $1,000
- A 6-month driver’s license suspension
License Restriction Option
First offenders also have the option of a 90-day restricted driver’s license that allows driving to work and to the required alcohol or drug education program, rather than serving the full suspension. An ignition interlock device (a breath-test device installed in your vehicle that prevents the engine from starting if alcohol is detected) may also be required.
